Business Litigation - Arbitration

The Business Litigation – Arbitration Department is headed by four partners, Cédric Fischer, Tristan de Puget, Silvestre Tandeau de Marsac and Marc Henry, and comprises a dedicated team of six associates.

FTMS offers fine legal expertise in civil and commercial litigation. Driven by a deep understanding of economic dynamics, the Department offers expert support to various domestic and international corporations  operating in a wide range of sectors.

The Department’s  expertise is built upon the complementary skills of each of its members. Specific  teams are formed for each matter to craft effective strategies and find pragmatic solutions to ensure the anticipation and resolution of pre-conflict and conflict situations in corporate and business affairs.

The Department handles a wide range of business litigation cases. These include litigation arising from M&A transactions, shareholder disputes, executive liability risks, economic law matters, product liability, industrial accidents and real estate disputes.

The Department’s lawyers have an in-depth knowledge of legal mechanisms, cultivate strong ties within the academic community and garnered considerable credibility among judicial experts and magistrates.

FTMS assists corporate entities in domestic and international arbitration proceedings, whether governed by French law or foreign legislation (including OHADA law). These proceedings may be subject to the jurisdiction of renowned institutions such as the ICC (International Chamber of Commerce), the ICSID (International Centre for Settlement of Investment Disputes), as well as the AFA (French Arbitration Association), where one of FTMS’s partners, Marc Henry, serves as President.

The Department’s lawyers are regularly sought after to serve as arbitrators in highly specialised matters.

The Department specializes in the following areas:

  • Corporate litigation: shareholder disputes, acquisition disputes, liabilities;
  • Commercial litigation: unfair competition, problems of “abrupt termination” or “significant imbalance”;
  • Real estate litigation: investment, real estate development, commercial leases, property and building contracts litigation;
  • Construction and industrial risk litigation;
  • International arbitration: OHADA law, mining law, defence and security;
  • Restitution of looted artworks.

Silvestre Tandeau de Marsac and Marc Henry also specialise in banking and financial disputes, and have an extensive experience in representing clients before administrative authorities.
